JDM City Virginia: Your Privacy Choices & Opt-Out Rights

This "Do Not Sell or Share My Personal Information" notice is issued by JDM City Virginia LLC ("JDM City Virginia," "we," "us," or "our"), a business based in Manassas, Virginia. It explains what personal information we collect, who receives it, and how you can opt out of its sale, sharing, or use for targeted advertising. It applies to everyone in the United States who visits this website or buys from us.

This page forms part of our Privacy Policy and should be read together with it and our Cookie Policy. Nothing on this page limits any privacy right you have under federal or state law.

1. Your Choice at a Glance

JDM City Virginia does not sell your personal information for money. However, as described in our Privacy Policy, we use Google Analytics and share information with our advertising partners Google, Meta (Facebook), and Microsoft (Bing) to measure and show our ads. These partners collect information through cookies and pixels on this website. Under some state privacy laws, this can count as a "sale" or "sharing" of personal information, or as "targeted advertising." You have the right to turn it off:

You do not need an account to opt out, and opting out never changes the prices you pay or the service you receive.

2. What This Page Covers

  • "Sale": Under laws such as the California Consumer Privacy Act (CCPA), a "sale" can include making personal information available to another company for something of value, not only for money. Virginia's law defines a "sale" more narrowly, as an exchange of personal data for money.
  • "Sharing": Under California law, making personal information available to a third party for cross-context behavioral advertising, meaning ads based on your activity across different websites and apps.
  • "Targeted Advertising": The term used by Virginia, Colorado, Connecticut, Texas, Oregon, and other states for ads selected using data about your activity over time and across unrelated websites or apps.
  • "Profiling": Automated processing of personal information to evaluate or predict things about a person. Some laws let you opt out of profiling used for decisions with legal or similarly significant effects, such as credit or employment decisions. We do not profile customers this way.
  • Service Providers: Companies that process personal information only on our behalf, such as our store platform, payment processors, and freight carriers. Disclosures to them are not a sale or sharing.
  • Third Parties: Companies that may also use information for their own purposes, such as advertising platforms. These are the disclosures you can opt out of.

3. Information We Collect & May Share

a) Categories of Personal Information

  • Contact Identifiers: Name, email address, phone number, and shipping and billing addresses. Used to process, ship, and support your order. We do not sell them. Where we use ad-measurement features that match conversions, advertising partners may receive contact details in hashed (coded) form. Opting out stops this.
  • Online Identifiers & Device Information: IP address, browser and device type, operating system, and cookie or pixel IDs. May be shared with advertising and analytics partners. You can opt out.
  • Browsing & Shopping Activity: Pages and products viewed, time on this website, referring website, searches, add-to-cart actions, purchases, and ad clicks, collected through cookies that expire between 30 minutes and two years. May be shared with Google, Meta, and Microsoft. You can opt out.
  • Payment Information: Billing address, payment method type, and the last four digits of your card. Card details are encrypted and processed by Shopify and our payment processors; we do not receive or store your full card number from online checkout. Not sold or shared.
  • Order & Vehicle Details: Products bought, order dates and amounts, delivery or pickup details, returns and warranty claims, and vehicle details you give us (such as a VIN or engine code) to help confirm compatibility. Not sold or shared, apart from the purchase events described above.
  • Approximate Location: State and ZIP code from your address, and general location derived from your IP address. Used for shipping quotes, delivery, and taxes. Location from your IP address may reach advertising partners through cookies and pixels. You can opt out.
  • Communications: Emails, calls, and messages with our team, and photos or mechanic's reports sent for a warranty or return claim. Not sold or shared.

b) Sensitive Personal Information

We do not ask for sensitive information such as Social Security numbers, precise geolocation, health information, or biometric data. Payment card details, which some laws treat as sensitive, are used only to complete your purchase and help prevent fraud. We do not use sensitive personal information to infer characteristics about you, and we do not sell or share it.

4. Who Receives Your Information

a) Service Providers (Not a Sale or Sharing)

  • Shopify: Shopify Inc. hosts this website and our checkout, stores order records, and provides store analytics on our behalf. Checkout runs in Shopify's PCI DSS Level 1 compliant environment.
  • Payment Processors: Shopify Payments and the options shown at checkout, such as Shop Pay, Apple Pay, and PayPal (where shown at checkout), receive the information needed to process your payment.
  • Freight & Shipping Carriers: Carriers receive your name, delivery address, and phone number to schedule and complete delivery, including LTL pallet and liftgate delivery.
  • Email & Communication Tools: The providers we use to send and receive emails, including order and tracking updates, process your messages on our behalf.

b) Advertising & Analytics Partners (Third Parties)

  • Google: Google Analytics shows us how visitors use this website. Google's advertising tools measure which ads lead to orders, show our ads to past visitors, and may use this information for Google's own purposes.
  • Meta (Facebook): Meta's tools measure our ads on Meta platforms such as Facebook and can show our ads to past visitors.
  • Microsoft (Bing): Microsoft's advertising tools measure our ads on Bing and can show our ads to past visitors.

c) Legal & Safety Disclosures

We may also disclose personal information when the law requires it, to respond to valid legal process, or to protect our customers, our business, or others from fraud.

5. Your Privacy Rights

State privacy laws apply only to businesses that meet certain size or data-volume thresholds, so the rights below apply where applicable. Whatever state you live in, we honor opt-out requests from every US customer, and we respond to requests to access, correct, or delete personal information from any US customer where we reasonably can.

a) Virginia Residents (VCDPA)

Where the Virginia Consumer Data Protection Act (Va. Code § 59.1-575 et seq.) applies, Virginia residents have the right to:

  • Access: Confirm whether we process your personal data and access that data.
  • Correct: Correct inaccuracies in your personal data.
  • Delete: Delete personal data you provided to us or that we obtained about you.
  • Portability: Get a copy of the personal data you provided to us in a portable and, where technically feasible, readily usable format.
  • Opt Out: Opt out of targeted advertising, the sale of personal data, and profiling in furtherance of decisions that produce legal or similarly significant effects.
  • Appeal: Appeal if we decline to take action on your request (see Section 9).

b) California Residents (CCPA/CPRA)

Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies, California residents have the right to:

  • Right to Know: Request the categories and specific pieces of personal information we collected about you, its sources, our purposes, and the categories of third parties we disclose it to.
  • Right to Delete: Ask us to delete personal information we collected from you, subject to legal exceptions.
  • Right to Correct: Ask us to correct inaccurate personal information.
  • Right to Opt Out of Sale or Sharing: Direct us to stop selling or sharing your personal information. We treat a GPC signal as a valid opt-out request.
  • Right to Limit Use of Sensitive Personal Information: Limit how we use sensitive personal information. We already use it only as needed to provide our products and services, and never to infer characteristics about you.
  • Right to Non-Discrimination: Exercise these rights without being treated differently (see part c below).

c) No Discrimination

We will not deny you goods or services, charge you different prices, or give you a different level or quality of service because you exercised your privacy rights. Opting out does not affect your orders, shipping, local pickup, or the terms of our Warranty Policy and Refund Policy.

6. How to Opt Out

Use any of the methods below. You do not need an account or identity verification to opt out. We may ask for limited information, such as the email address or phone number you used with us, only to find your records.

  1. Email Us: Send an email to jdmcityvirginia@gmail.com with the subject line "Do Not Sell or Share Request." Include your name and the email address or phone number you used with us. Your state of residence is optional.
  2. Call Us: Call (703) 479-7400 during business hours (Mon–Fri: 9am–5pm, Sat: 9am–3pm, Eastern Time) and tell our team you want to opt out.
  3. Turn On Global Privacy Control: Use a browser or extension that supports Global Privacy Control and turn it on. Shopify honors GPC automatically: when your browser sends the GPC signal, it opts you out of data sale or sharing and targeted advertising by Shopify and third parties on this website.
  4. Use the Cookie Banner: Where a cookie banner or privacy preferences option is shown on this website, use it to decline advertising and marketing cookies on that browser. See our Cookie Policy for details.
  5. Use Each Platform's Settings: Limit personalized ads directly through Google's ad settings, the Google Analytics opt-out browser add-on, the ad preferences in your Facebook (Meta) account, the personalized ad settings in your Microsoft account, and the Digital Advertising Alliance's WebChoices tool. Those companies control these settings, not JDM City Virginia.

You can also block or delete cookies through your browser settings, although some features, such as the cart, may not work if all cookies are blocked.

7. What Happens After You Opt Out

  • Timing: We process email and phone opt-outs as soon as possible and no later than 15 business days after we receive them. GPC and cookie banner choices usually take effect right away on that browser.
  • What Changes: We stop selling or sharing your personal information and using it for targeted advertising. Our service providers can still use it to process, ship, and support your orders. Where the law requires, we notify third parties that received your information between your request and our action on it.
  • Browsers & Devices: GPC and cookie choices apply only to the browser and device where you set them, so set them again on each browser or device you use, or after clearing cookies. An email or phone opt-out applies to the information we hold that is linked to you, such as your email address and order records.
  • Ads You May Still See: You may still see ads, including ours, that are not targeted using your activity on this website. Platforms may also show ads based on other information they hold, which you can manage in their settings.
  • Confirmation: If you opt out by email or phone, we will reply to confirm when your opt-out is in place.
  • Authorized Agents: An authorized agent may submit a request for you with your signed written permission. For requests other than opt-outs, we may also ask you to verify your identity directly, unless the agent holds a valid power of attorney.
  • Changing Your Mind: You can opt back in at any time. We will not ask you to do so for at least 12 months after you opt out.

8. Other Privacy Requests & Verification

To access, correct, delete, or get a copy of your personal information, email jdmcityvirginia@gmail.com with the subject line "Privacy Request," or call us during business hours. Tell us what you are requesting and your state of residence.

  • Verification: We must verify your identity first, usually by matching your name, email address, phone number, and a recent order number with our records. We use these details only to handle your request.
  • Response Time: We respond within 45 days of receiving your request. Where the law allows, we may extend this once by another 45 days and will tell you why within the first 45 days.
  • Exceptions: Some records must be kept after a deletion request, such as those needed to complete an order, handle a warranty or return claim, prevent fraud, or meet tax and legal requirements. If we cannot fully meet your request, we will explain why.
  • Cost: Requests are free, except that where the law allows, we may charge a reasonable fee for, or decline, requests that are manifestly unfounded, excessive, or repetitive.

9. Appeals

If you are a Virginia resident and we decline to take action on your privacy request, in whole or in part, you can appeal:

  1. Send Your Appeal: Reply to our decision with the subject line "Privacy Request Appeal," or email jdmcityvirginia@gmail.com with that subject line. Include your name, the date of your original request, and why you disagree.
  2. Our Response: We will respond in writing within 60 days of receiving your appeal, explaining any action taken or not taken and our reasons.
  3. Contact the Attorney General: If your appeal is denied, you may submit a complaint to the Virginia Attorney General through the Office of the Attorney General's consumer protection page.

Residents of other states with a right to appeal, such as Colorado, Connecticut, Texas, and Oregon, can use the same process. We will respond within the time your state's law requires and, if we deny your appeal, tell you how to contact your state Attorney General.

10. Privacy Rights in Other States

Where they apply, the privacy laws of many other states give rights similar to Virginia's: to access, correct, delete, and get a copy of personal data, and to opt out of targeted advertising, sales, and certain profiling. Some notable differences:

  • Colorado (Colorado Privacy Act): Recognizes universal opt-out signals such as GPC. Denied appeals can be raised with the Colorado Attorney General.
  • Connecticut (Connecticut Data Privacy Act): Lets residents opt out through a recognized universal opt-out signal.
  • Texas (Texas Data Privacy and Security Act): Includes a right to appeal, with denied appeals raised with the Texas Attorney General.
  • Oregon (Oregon Consumer Privacy Act): Adds a right to get a list of the specific third parties that received your data.
  • Other States: Residents of states such as Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Rhode Island, Tennessee, and Utah have similar rights that vary by state.

Wherever you live in the United States, you can use every opt-out method on this page, whether or not a state privacy law applies to us.

We may update this page when our data practices or privacy laws change, and we will post the new version here with a new "Last Updated" date. If you have opted out, your choice stays in place after any update.
